As per the bylaws of the SPPC, shareholders must pay annual service charges, proportionally to the number of shares they own. These service charges constitute the annual maintenance budget of the port and its infrastructures. They are paid twice a year. When a shareholder sells his shares, the service charges he/she has paid for ongoing year are refunded on a pro rata temporis basis.
This fee is to be paid to the Port's Administration for registering the transfer of shares, for registering the new shareholder and for submitting his/her request to become Amodiataire.
Additional Costs or Fees:
5.80665% of the group of shares' purchase price is to be paid by the Buyer to French Treasury.
In order to obtain the status of Amodiataire (or Beneficiary of a berth) from France (in this instance, the Metropole Nice Côte d'Azur), the applicant must be the owner of a group of shares in the SPPC (i.e. the port) corresponding to the berths category (it is not the only requirement in order to benefit from an amodiation contract. This tax, called Droit d'Enregistrement is due by the Buyer to the French Treasury for the transfer of these shares and is payable no later than a month following the registration of the share transfer. The Port's Administration has exclusivity over the management of all berth rentals. Therefore all rentals in the Port of Cap d'Ail can only be contracted with the Port Office (Capitainerie).
